Krasaba End User License Agreement (EULA)

Effective December 18, 2023

This End User License Agreement ("EULA") governs your access to and use of Krasaba's products and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by this EULA. If you do not agree to this EULA, you may not access or use the Services.

1. License Grant. Krasaba grants you a non-exclusive, non-transferable, limited license to access and use the Services for your personal, non-commercial purposes. You may not modify, distribute, sublicense, or commercially exploit the Services in any way.

2. Acceptable Use. You agree to use the Services only for lawful purposes and in accordance with this EULA. You agree not to use the Services:

To harm or threaten others.
To engage in illegal or fraudulent activity.
To violate the privacy of others.
To transmit or distribute harmful content, such as viruses or malware.
To interfere with the operation of the Services.

3. User Content. You may be able to submit content to the Services, such as text, images, and videos ("User Content"). You retain all ownership rights to your User Content. However, by submitting User Content, you grant Krasaba a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute your User Content in connection with the Services. You agree that your User Content will not be illegal, offensive, or harmful.

4. Disclaimers. THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. KRASABA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

5. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRASABA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

6. Termination. Krasaba may terminate this EULA for any reason at any time.

7. Governing Law. This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.

8. Entire Agreement. This EULA constitutes the entire agreement between you and Krasaba with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
